These Terms of Service ("Terms") govern your use of vergemount.in (the "Site"), operated by Vergemount ("Vergemount," "we," "us"). By visiting or using the Site — including submitting the quote form or newsletter signup — you agree to these Terms. If you don't agree, please don't use the Site.

1. About This Site

The Site is a portfolio and marketing site describing products and client work associated with Vergemount, including but not limited to Polymathos, Noviq, MarketCraft, and WEBUILD. Each linked product may operate under its own separate terms of service and privacy policy, which govern your use of that product. Nothing on this Site forms a contract between you and Vergemount for those products merely by virtue of linking to them here.

2. Eligibility

The Site is intended for business and professional visitors evaluating our work or requesting a quote. It is not directed at children under 18, and by using the Site you represent that you are old enough, under the laws of your jurisdiction, to enter into these Terms.

3. Acceptable Use

You agree not to: (a) submit false, misleading, or fraudulent information through the quote form or newsletter signup; (b) attempt to probe, scan, or breach the security of the Site; (c) use automated means (bots, scrapers) to extract content at scale without our permission; or (d) use the Site for any unlawful purpose. We may block access from anyone we reasonably believe is violating these Terms.

4. No Warranty on Descriptions

Product descriptions, launch status, and availability information on this Site (e.g., "pre-launch," "open beta," "first tier live") are provided for informational purposes and may not reflect real-time status. We update this information periodically but do not guarantee it is current at all times.

5. Quote Requests & Engagements

Submitting the quote form is a request for information, not a binding order, deposit, or contract. A paid engagement only comes into existence once both parties separately agree in writing to a fixed price, timeline, and scope of work; these Terms do not themselves constitute that agreement. We aim to reply to serious requests within two business days, but that timeframe is a goal, not a guaranteed service level.

6. Intellectual Property

All original content on this Site — text, design, logos, and case study descriptions — is owned by Vergemount or its founders unless otherwise noted. You may not reproduce, distribute, or create derivative works from this content without written permission. The Vergemount name and mark may not be used to imply endorsement without our consent.

7. Third-Party Links

This Site links to external products and social platforms (Instagram, X/Twitter, email) and relies on third-party infrastructure (see our Privacy Policy). We are not responsible for the content, availability, security, or practices of these third-party destinations. Visiting them is at your own risk and subject to their own terms.

8. Client Work References

Where the Site references client engagements (e.g., under WEBUILD), such references are provided with the relevant client's permission or are anonymized/generalized. We do not disclose confidential client information without authorization.

9. No Professional or Investment Advice

Nothing on this Site constitutes financial, legal, or investment advice, including content related to MarketCraft or any markets-education product referenced here. Decisions you make based on this Site's content are your own responsibility.

10. Disclaimer of Warranties

13. Force Majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including outages of our hosting or form-processing providers, internet infrastructure failures, or other events beyond our control.

14. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vergemount regarding use of the Site, superseding any prior understandings about the Site itself.

15. Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms. Material changes will be reflected with an updated "Last updated" date above.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, with courts in Bangalore, Karnataka having exclusive jurisdiction over any disputes. Before filing a claim, we ask that you first contact us directly so we can try to resolve the issue informally.
